Terms and Conditions
Draft for review by a lawyer. Last updated: 15.10.2026.
1. The Seller
The online shop elesiart.com is run by „Елеса“ ЕООД, company number (EIK) 205416727, VAT No. BG205416727, registered office гр. Казанлък, ул. „23-ти Пехотен Шипченски полк“ № 82 (the “Seller”). Contact: email [email protected], phone 0988 23 2001.
2. Scope
These Terms and Conditions govern the relationship between the Seller and anyone who orders through the website (the “Customer”) when buying handmade jewellery, pendulums, scarves, bags and accessories, stones and minerals, paintings, art pieces and gifts, as well as digital products (downloadable files).
By ticking “I agree to the Terms and Conditions” when ordering, the Customer confirms that they have read and accept them. Each order is governed by the Terms and Conditions published on the website at the time it is placed. This English version is provided for convenience; if it differs from the Bulgarian version, the Bulgarian version prevails.
3. Products and prices
Many of the pieces are handmade and one of a kind. The photos show the actual item, but colours may look slightly different depending on your screen. Small variations in shape, glaze and pattern are part of the handmade process and are not defects.
Prices are in euros (€) and include 20% VAT. The price shown on the website at the time of the order applies.
Delivery is not included in the product prices. It is charged by the courier, Econt, at its current rates, and the Customer pays it to the courier on receipt of the parcel. For any questions about delivery, the Customer can contact the Seller directly.
4. Placing an order and conclusion of the contract
- The Customer adds products to the cart and enters their name, email, phone number, delivery method and payment method. No account is needed.
- Once the order is sent, the Customer receives an email saying it has been received. This email does not mean that the contract has been concluded.
- The Seller confirms every order by phone, except orders from regular customers, which are treated as confirmed when they are received. The contract is concluded on confirmation.
- The Seller may decline an order if it cannot reach the Customer on the phone number given, if the item is no longer available, or if misuse is suspected. If a declined order has already been paid for, the full amount is refunded.
5. Delivery
Orders are delivered by Econt — to an address, to an Econt office or to an Econtomat (Econt parcel locker), as chosen by the Customer. When the parcel is handed over to the courier, the Customer receives an email with the waybill number and a tracking link.
We recommend checking the parcel on receipt. If the packaging is visibly damaged, please point this out to the courier and let the Seller know as soon as possible.
Orders containing only digital products are not sent by courier — see section 7.
6. Payment
- Cash on delivery — the Customer pays the courier on receipt of the parcel. This is the main payment method.
- Card payment online — when available, through the virtual POS terminal of First Investment Bank (Fibank). Card details are entered on the bank’s own page; the Seller never sees or stores them.
- Bank transfer — only for orders that contain digital products only. The bank account, amount and payment reference are sent in the order confirmation email.
7. Digital products
Some pieces are also sold as a digital file (for example, a high-resolution image of a painting). The Customer receives a download link by email:
- for card payments — as soon as the bank confirms the payment;
- for bank transfers — once the Seller has received the money;
- for cash on delivery (when the file is ordered together with physical products) — once the parcel has been received and paid for.
The link is valid for 30 days and allows up to 5 downloads of each file. If the link expires before you have downloaded the file, get in touch and we will send you a new one.
When ordering a digital product, the Customer gives explicit consent for the file to be supplied immediately and acknowledges that they thereby lose their right of withdrawal for it (Art. 57(13) of the Bulgarian Consumer Protection Act).
8. Right of withdrawal
A Customer who is a consumer may withdraw from the contract without giving any reason and without penalty within 14 days of the day on which they, or a person they have named (other than the courier), receive the goods (Art. 50 of the Consumer Protection Act).
To withdraw, the Customer must inform the Seller before the period ends — by email to [email protected] or by letter to гр. Казанлък, ул. „23-ти Пехотен Шипченски полк“ № 82 — quoting the order number. The model withdrawal form at the end of these terms may be used, but this is not compulsory.
The Customer must send the goods back no later than 14 days after giving notice. Before sending them, it is best to contact the Seller to agree the address or office to send them to. The cost of returning the goods is borne by the Customer. The goods must be in the condition in which they were received; the Customer is liable for any loss in value caused by handling them more than is necessary to examine them.
The Seller refunds the amounts received from the Customer for the goods within 14 days of receiving the withdrawal notice (Art. 55 of the Consumer Protection Act), using the same means of payment unless the Customer agrees otherwise. For cash on delivery orders, the refund is made by bank transfer to an account given by the Customer. The Seller may withhold the refund until the goods have been received back or the Customer has supplied proof of having sent them.
The right of withdrawal does not apply (Art. 57 of the Consumer Protection Act) to:
- items made to order, to the Customer’s specifications or clearly personalised (Art. 57(3));
- digital content supplied after the Customer’s explicit consent under section 7 (Art. 57(13)).
9. Complaints about faulty goods
The Seller is liable for any lack of conformity of the goods with the contract under the Bulgarian Act on the Supply of Digital Content and Digital Services and the Sale of Goods. The Customer may make a complaint if the goods are damaged, faulty or not as described.
Complaints can be made by email to [email protected] or by phone on 0988 23 2001, giving the order number, a description of the problem and, if possible, a photo. The Seller will confirm receipt and offer a remedy — repair, replacement, a price reduction or a refund, depending on the case and as provided by law.
10. Personal data
The Seller processes the Customer’s personal data only to fulfil the order and meet its legal obligations. Details are given in the Privacy Policy and the Cookie Policy.
11. Disputes
The Seller and the Customer will try to settle any dispute by mutual agreement. The Customer may also contact the Bulgarian Commission for Consumer Protection (kzp.bg) or an alternative dispute resolution body for consumer disputes, such as the Conciliation Committees at the Commission. If no agreement is reached, the dispute is settled by the competent Bulgarian court.
12. Changes
The Seller may change these Terms and Conditions. Changes do not affect orders placed before they were published.
